Terms and Conditions for Nashik Marathon
Effective Date: 10th June 2025
Please read these Terms and Conditions ("Terms") carefully. By registering for the Nashik Marathon ("the Event"), you ("Participant," "you," or "your") agree to be bound by these Terms and Conditions, which constitute a legally binding agreement between you and Nashik Marathon ("Organizer," "we," "us," or "our").
1. Event Overview
The Nashik Marathon is an annual road running event featuring Half Marathon, 10K, and 5K race categories. The Event is scheduled for 24th August 2025, with specific start times and routes to be announced closer to the event date.
2. Registration and Eligibility
2.1. Registration Process: Registration for the Event can be completed online via www.nashikmarathon.org or through designated offline forms.
2.2. Age Categories: While there is no strict age limit for participation, participants will be grouped according to age categories for results and awards.
2.3. Medical Fitness: By registering, you confirm that you are physically fit and medically sound to participate in the chosen race category. You acknowledge the inherent risks associated with marathon running, including but not limited to falls, contact with other participants, effects of weather, traffic, and course conditions. You should consult with a medical professional if you have any doubts about your ability to participate.
2.4. Accuracy of Information: You agree to provide accurate, current, and complete information during the registration process. Providing false or misleading information may lead to disqualification from the Event.
3. Fees and Payment
3.1. Registration Fees: All registration fees are subject to change and will be disclosed prior to the opening of registration. Different race categories will have different fees. Early bird discounts may be available.
3.2. Payment Methods: Online payments are processed exclusively through Razorpay. Offline registrations can be paid for in cash.
3.3. No Cancellation, No Refunds: Once registration is complete and payment is made, participation cannot be cancelled, and no refunds shall be given for any reason, including but not limited to injury, illness, personal commitments, or inability to attend the event. This policy applies regardless of the circumstances leading to the participant's inability to participate.
4. Event Cancellation or Postponement by Organizer
4.1. In the unlikely event that the Nashik Marathon is cancelled, postponed, or altered due to circumstances beyond the Organizer's control (e.g., natural disasters, acts of God, epidemics, pandemics, government orders, riots, war, or any other force majeure event), the Organizer reserves the right to make decisions regarding the event's status.
4.2. In such cases, no refunds of registration fees will be issued. The Organizer's primary objective will be to ensure participant safety and compliance with official directives. The Organizer may, at its sole discretion, offer alternatives such as deferral of registration to a future edition of the Nashik Marathon or other solutions as deemed appropriate under the circumstances. Any such decision will be communicated to registered participants.
5. Race Bibs and Participant Kits
5.1. Physical Collection: All race bibs, timing chips, t-shirts, and any other participant kit items must be collected physically by the registered participant at a designated Race Expo or bib collection point prior to the Event date. Details regarding the collection dates, times, and venue will be communicated.
5.2. No Shipping: No race bibs or participant kit items will be shipped to participants' addresses.
5.3. Finisher Medals: Finisher medals will only be awarded at the venue after the race is successfully completed within the stipulated cut-off time.
6. Race Rules and Participant Conduct
6.1. Adherence to Rules: Participants must adhere to all rules and regulations issued by the Organizer, including those communicated at the start line, along the course, and at the finish line.
6.2. Bib Transfer: Bib numbers are strictly personal and cannot be transferred, sold, or shared with any other individual. Any participant found using a bib number not assigned to them will be disqualified, and both the original registrant and the person using the bib may be banned from future events.
6.3. Course Adherence: Participants must follow the official race course as marked and instructed. Shortcutting the course will lead to disqualification.
6.4. Medical Assistance: Participants agree to allow medical personnel designated by the Organizer to administer first aid or medical treatment if deemed necessary.
6.5. Environmental Responsibility: Participants are requested to dispose of waste in designated bins along the course.
6.6. Disqualification: The Organizer reserves the right to disqualify any participant who violates these Terms, acts in an unsportsmanlike manner, or endangers other participants or event staff.
7. Image and Likeness
By registering for and participating in the Nashik Marathon, you grant the Organizer and its partners, licensees, and assigns the irrevocable, perpetual, worldwide right to use your name, likeness, image, voice, and athletic performance in any media, whether now known or hereafter developed, for the purposes of advertising, promoting, and publicizing the Event or any future events without further compensation to you.
8. Disclaimer of Liability
8.1. You understand and acknowledge that participating in a marathon is a potentially hazardous activity. You voluntarily assume all risks associated with participating in the Event, including but not limited to falls, contact with other participants, effects of weather, traffic, and conditions of the road, all such risks being known and appreciated by you.
8.2. You hereby release, waive, discharge, and covenant not to sue the Organizer, its affiliates, employees, volunteers, sponsors, officials, and agents from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by you, or any property belonging to you, whether caused by the negligence of the Releasees or otherwise, while participating in the Event, or while in, on, or upon the premises where the Event is being conducted.
9. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Nashik, Maharashtra, India.
10. Amendments
The Organizer reserves the right to amend these Terms and Conditions at any time. Any changes will be posted on the official Event website and will be effective immediately upon posting. Your continued participation in the Event after such amendments constitutes your acceptance of the revised Terms.
